DMCA Notice & Takedown Policy

Braporn (“we”, “us”, “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf, Braporn will respond expeditiously to claims of copyright infringement committed using the Braporn website (braporn.net) that are reported to our Designated Copyright Agent identified below.

About Our Service

Braporn is an indexing service that embeds video content hosted on third-party platforms. We do not host, store, upload, or transmit any video files on our servers. All videos displayed on Braporn are embedded directly from external third-party websites that operate independently of Braporn. If you believe content embedded on our site infringes your copyright, the original file is hosted by a third party, and you may also wish to contact that host directly for faster removal of the source file.

Filing a DMCA Notice of Alleged Infringement

If you are a copyright owner, or authorized to act on behalf of one, and you believe that copyrighted material has been used in a way that constitutes copyright infringement, please submit a written notice of alleged infringement (“DMCA Notice”) to our Designated Copyright Agent containing all of the following information, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide the full URL(s) of the specific page(s) on braporn.net where the allegedly infringing material appears.
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

We will only accept DMCA Notices submitted via email. Please use “DMCA Notice” as the subject line.

Processing Time

We aim to review and process valid DMCA Notices within a reasonable time, typically 24 to 72 hours of receipt. Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material expeditiously.

False Claims Warning

Please be aware: under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider. If you are unsure whether the material you are reporting is in fact infringing, you should contact an attorney before filing a notice with us.

Counter-Notification

If you believe that content you posted, embedded, or otherwise made available on Braporn was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent containing the following information, as required by 17 U.S.C. § 512(g)(3):

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Braporn may be found), and a statement that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.

Upon receipt of a valid counter-notification, we may reinstate the material in not less than 10 nor more than 14 business days following receipt of the counter-notification, unless we first receive notice from the original complainant that they have filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Braporn has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the access of users who are deemed to be repeat infringers. We may also at our sole discretion limit access to our website and/or terminate the access of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
